In this action for the specific performance of a contract to sell real estate alleged lo have been executed by the vendor’s agent and for damages for its breach, the court rendered judgment for the defendant. The plaintiff has appealed.

The essential facts found may be stated as follows: The defendant, as trustee, owned four lots •of land which he had listed for sale with a real •estate agent.
