This was an action brought by James A. Odum against the St. Louis, Alton and Terre Haute Railroad Company, to recover damages for an injury received while crossing defendant’s track in a public highway near Marion, in Williamson county, on the sixth day of October, 1892. The declaration contained two counts. In the first count the defendant is charged with negligence in running its trains at a high and dangerous rate of speed.
