MOREMEN, Judge.
Ross Chumbler died when- Gene Thurmond’s automobile, in which Chumbler was a passenger, overturned. Appellee Wanda Chumbler, administratrix of the estate of Ross Chumbler, brought suit against -Thurmond for damages which resulted in a judgment in the sum of $10,000.
The appellee’s decedent, Ross Chumbler, the appellant Gene Thurmond, Bobby Joe Cain, Melvin Barks and Watson Roberts, all residents of Murray, Ky., worked for the Carbide Chemical Corporation, whose plant was near Paducah, on the work shift that extended between 4 p. m. and midnight.
