Defendant in error brought this suit to recover of plaintiff in error damages for the destruction of certain personal property and for injury to certain real estate owned by defendant in error, alleging that said loss and injury was caused by a fire negligently set out by the plaintiff in error. The personal property alleged to have been destroyed consisted of a lot of nursery trees and the growing crop of hay upon about eighty acres of plaintiff’s land.
