THIS CAUSE came on to be heard on November 6, 1984, upon the Motion to Dismiss filed by the Federal Deposit Insurance Corporation, in its corporate capacity (“FDIC”) alleging that the Chapter 11 proceeding commenced by the debtor, American Property Corporation (“APC”) was not commenced in good faith and in accordance with the underlying principles of the Bankruptcy Code.
