Appeal by the defendants,' Harriet A. Huntington and another, as executrices, etc., from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the cleric of the county of Onondaga on the 23d day of July, 1906, upon the decision of the court rendered after a trial at the Onondaga Special Term.

Ho controverted question of material fact appears in the record presented in this case, and a recital of the facts disclosed by the evidence will direct us to the well-settled principles of law to be applied in determining the rights of the parties to the action, which the judgment should have declared.
