—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: In 1989 Randolph Manzella shot Erie County Sheriffs Deputies David Carlson and William M. Dillemuth as they arrived at Manzella’s home to arrest Manzella pursuant to a bench warrant. Manzella injured Carlson and killed Dillemuth. Carlson and his wife, and William M.
