“On the 20th day of September, 1906, appellants filed their suit in the District Court of Henderson County, Texas, against J. A. Mobley, County Attorney, to contest an election that had been held on the 1st day of September, 1906, in Justice Precinct No. 1, Henderson County, Texas, to determine whether or not the sale of intoxicating liquors should be prohibited in said Justice’s Precinct.
