Appellant was convicted in Douglas County of the felony of having carnal knowledge of an unmarried female of previously chaste character, between the ages of sixteen and eighteen years. [Sec. 3248, R. S. 1919, as amended by Laws 1921, p. 284a.] The jury assessed the punishment at a fine of $250 and imprisonment in the county jail for six months.

The sufficiency of the information is vigorously assailed on the sole ground that appellant was therein alleged to have been “a person over the age of sixteen years.” It is the contention of appellant that the failure of the information to allege that…
