OPINION OF THE COURT

John F. O’Donnell, J.

The petitioner has filed objections to an order of a Hearing Examiner dismissing his petition for a downward modification *546of child support. That petition alleged two grounds for the modification: a decline in income, and the emancipation of one of the parties’ two children.

The order sought to be modified applied the guidelines set out in the Child Support Standards Act (Family Ct Act § 413), and required the petitioner to pay $40 per week plus the taxes, insurance and a portion of the rent for the residence where the respondent and the children reside.…
