Affirming.

On January 22, 1891, a commissioner’s deed was made to J. H. Middleton and Ms wife Elizabeth for one hundred and thirty-one (131) acres of land in Harlan county. In May, 1893, they executed a mortgage on this land. After this mortgage was executed the wife Elizabeth died leaving two daughters surviving her. They were then unmarried but both of them married after-wards. In 1894 J. H. Middleton married his present wife Josephine, and on September 1, 1896, he by deed conveyed to her the one hundred and thirty-one acres of land. She and…
