This case was before the Supreme Court on a former occasion. Becker v. Donalson, 133 Ga. 864 (67 S. E. 92). In that instance Donalson had recovered, and Becker excepted to the judgment of the trial court refusing a new trial. On review in the Supreme Court the judgment was reversed. On the subse*636quent trial Donalson again recovered. Becker moved for a new trial, and excepted to the judgment overruling the motion. It is unnecessary to refer to the character of the suit further than to say that it was one for specific performance and other equitable relief.
