ROSE, Circuit Judge.

This patent cause has some features out of common. In July, 1915, the appellant, the plaintiff below, brought suit against the defendant, appellee here, alleging the infringement of reissue No. 12,159 of letters patent No. 772,248 granted March 10, 1903, to one Samuel F. Patterson. The case moved along with the deliberation characteristic of patent litigation until, about three years _and a half later, this.court affirmed a decree below dismissing plaintiff’s bill.
