The plaintiff seeks to recover the purchase price of 100 cases of canned apples which, through its salesman, Clarence L. Jeffrey, it claims to have sold to defendant at St. Albans, on July 28, 1920. Defendant was the keeper of the depot restaurant at that place. The plaintiff’s only evidence of the terms of the contract of sale was that given by Jeffrey who testified to the conversation with defendant on the day named, which led up to the latter’s ordering 100 cases of canned apples.
