Appellant recovered judgment before a justice of the peace, from which appellee, who was the de*526fendant below, appealed to the circuit court. In the trial court appellee’s demurrer to an amended complaint was sustained. The complaint is in replevin and seeks to recover the body of a dead dog. Whether it states facts sufficient to constitute a cause of action is the only question presented by this appeal.
