This is an action of assumpsit commenced by Edward Browne, Robert R. Chapin, William P. Carey and Arthur C. Rombard, as partners doing business as the BrowneChapin Rumber Company, against the Raing Rumber Company, which has been succeeded by the Sagola Rumber Company, the appellant herein. After the suit was instituted the Chicago Title and Trust Company, as trustee in bankruptcy of Edward Browne, was substituted in the place of the bankrupt, and the suit proceeded to judgment after this change of parties.
