Proceeding pursuant to CPLR article 78 (transferred *1268to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Comptroller which denied petitioner’s application for disability retirement benefits.

Petitioner, an automotive mechanic for a school district, injured his left foot in January 2001 when he attempted to board a school bus.
