Appellant, Robert Perdue, plaintiff in the trial court, filed this suit in the district court of the 124th judicial district, Gregg county, on the 29th day of January, 1932, against appellees, A. W. Miller and others, as defendants, in trespass to try title, seeking to set aside a judgment rendered in the district court of the 71st judicial district, Gregg county, on the 17th day of May, 1919, in cause No. 3065, styled Katie Lee Yernon et al. v.
