On the 17th day of April, 1935, the trial court entered its order sustaining a demurrer to the petition of the plaintiff and dismissing the action, from which this appeal is taken. A brief has been filed; under date of October 15, 1935, by plaintiff which calls attention to the error of the court in sustaining the demurrer to the petition, and plaintiff alleges that Savery v. Board of Com’rs of Beaver County, 173 Okla. 284, 48 P. (2d.) 275, disposes of the issues of law involved in his favor. In that ease we held:
