Elezovic v. Ford Motor Co.

Michigan Court of Appeals

Decided April 24, 2007No. Docket 267747Published

1DissentTalbot, J.

I respectfully dissent. Specifically, I believe the majority’s conclusion, holding defendant Daniel E Bennett individually liable under the Michigan Civil Rights Act (CRA), MCL 37.2101 et seq., as an agent of the Ford Motor Company, is inconsistent and incompatible with the definitional requirements necessary to establish Bennett as an agent and, consequently, as an employer under the CRA. I would, therefore, affirm the trial court’s decision to grant summary disposition in favor of Bennett on plaintiff Lula Elezovic’s hostile work environment claim.

This case is once again before this Court,…
