State v. Harrington

Supreme Court of Vermont

Decided November 4, 2002No. 01-510PublishedCited by 1 opinion

1Opinion of the Court

Defendant appeals his jury conviction of domestic assault, arguing that (1) the evidence was insufficient to convict him of recklessly causing bodily injury to the victim, and (2) the trial court committed prejudicial error by refusing to instruct the jury that his previous family court testimony, which had been admitted at trial, could be considered as substantive evidence. We conclude that the evidence was sufficient to support the conviction, and that defendant was not prejudiced by the court’s failure to charge the jury as requested. Accordingly, we affirm the conviction.
