Williams, Judge :

Teresa Panetta was indicted for the murder of one James Areno, tried and convicted of voluntary manslaughter, and sentenced to an indeterminate confinement in the jienitentiary of not less than one nor more than five years, and she brings error.

The homicide occurred about seven o’clock on the morning of the 2nd of April, 1918, after defendant’s husband had gone to *215bis work. Sbe is tbe only eye witness to tbe tragedy, and swears deceased entered ber bouse by tbe front door by means of a key, just after sbe bad gotten out of bed and started down stairs.
