delivered the opinion of the court.
This is an appeal from a judgment in favor of the plaintiff for the sum of $3,585.99, which represents the amount, with interest, of a check signed by the defendant, payable to the order of B. C. Ackermann and by him indorsed to the order of the plaintiff.
The amended statement of claim alleges that the check was executed, indorsed and delivered on the day of its date, and was given in pursuance of the terms of a “settlement agreement,” entered into on the same day, which is set forth in full in the statement of claim. That…
