"We think that the only questions necessary for us to decide on this record are: (1) Does the general county court of Buncombe County, N. C., have authority under the facts in this case to appoint a receiver? ~We think -not. (2) When the judgment was transcripted and docketed in the Superior Court, was the general county court functus officio ? We think so.
