MEMORANDUM OPINION AND ORDER

I. INTRODUCTION
This case is before the court on a Motion to Dismiss (Doc. # 20) filed by Defendant United States of America (the “Government”) and a Motion to Strike (Doc. # 24), filed by Plaintiff Edward N. Kuhlman (“Kuhlman”).
Kuhlman filed an Amended Complaint (Doc. # 17) in this court on March 9, 2011, bringing a claim of negligence against the Government under the Federal Tort Claims Act (“FTCA”), 28 U.S.C. § 2671 et seq. The United States has moved to dismiss this case, pursuant to Federal Rule of Civil Procedure…
