This suit arose from a 1993 automobile accident in which plaintiff Linda Herrman (“Herrman”) was a passenger in a car insured by defendant Allstate Insurance Company (“Allstate”). Herrman sought first-party and uninsured motorist (UM) payment from Allstate, which Allstate denied. In 1997, Herrman brought this suit against Allstate, seeking the appointment of a neutral arbitrator and alleging that Allstate handled Herrman’s insurance claims in bad faith.
