Schneider, J.), dated December 16, 2004, granting tenant’s motion for summary judgment dismissing the petition in a nonprimary residence holdover summary proceeding, reinstated the petition, and dismissed the second through fourth affirmative defenses, unanimously affirmed, without costs.
