Judgment, Supreme Court, New York County, (Alfred Kleiman, J.), rendered May 11, 1989, convicting defendant after a jury trial of criminal sale of a controlled substance in the third degree and sentencing him to an indeterminate prison term of from VA to 4 years, unanimously affirmed.
Defendant, who was tried for selling a quantity of "crack” to an undercover officer, waived his right to counsel at trial, because he did not want to be represented by Legal Aid and was refused the appointment of substitute counsel.
