Defendant, a 22-year-old deaf and mute male, is charged in *516the present indictment with acting in concert with another person to commit the crimes of criminal sale of a controlled substance in the third degree (Penal Law § 220.39), criminal possession of a controlled substance in the third degree (Penal Law § 220.16 [1]) and criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03).
