MEMORANDUM OPINION
WALTON, District Judge.
On December 8, 2003, this Court issued a Memorandum Opinion denying the plaintiffs’ request for a temporary restraining order to prevent a black bear hunt in a portion of the Delaware Water Gap National Recreation Area located in the State of New Jersey. Fund for Animals v. Mainella, 294 F.Supp.2d 46, 59 (D.D.C.2003). The merits of the case are still pending before this Court, however, the defendants have now filed a motion to dismiss this case contending that it has become moot.
