On the 8th day of January, 1895, a little after five o’clock in the afternoon, at the office of one Adolph Lissner, at No. 228 East Sixth street; in the city of Hew York, the defendant, Tuefil Tuczkewitz, shot and killed one Adolph Balensiefer. The defense interposad upon the trial was that of insanity. There is some little variance in the testimony of the witnesses as to the minor details, to which attention will be called, but the controlliag facts are without material dispute.
