Judge’s 'Memorandum

KERR, District Judge.

Plaintiffs, comprised of fifty-four former supervisory employees of Union Pacific Coal Company, 1 bring this action against the Coal Company to enforce an oral agreement which was to provide pension benefits to supervisory employees.

The case was filed on February 23, 1971, in the District Court for Sweet-water County, Wyoming. On March 29, 1971, defendants removed this case to this court pursuant to 28 U.S.C. § 1441 (c). Plaintiffs filed their motion to remand the case to state court on June 18, 1971.
