Massachusetts Mutual Life Insurance Company prosecutes this writ of error to a judgment rendered against it in the circuit court of Kanawha County on June 20, 1934, in favor of Louis Corey in a proceeding by notice of motion brought on a policy of life insurance issued by the plaintiff in error upon the life of Joe Corey in which the plaintiff, Louis Corey, was the named beneficiary. The judgment was entered after the defendant’s demurrer to the amended notice of motion bad been overruled, the defendant declaring its desire not to plead further and relying upon its demurrer to…
