on August 17,1.880, the parties in this action entered into the following contract:

“Articles of agreement, made this seventeenth day of August, one thousand eight hundred and eighty, between Jacob M. Mills, of Brown county, Kansas, and Jacob Ruehlin, of Lyon county, Ohio, of the second part, witnesseth: That said party of the first part hereby covenants and agrees, that if the party of the second part shall first make the payments and perform the covenants hereinafter mentioned, on his part will convey and assure to the party of the second…
