Appellee filed his bill in the Superior Court of Chancery, to redeem certain slaves alleged to have been mortgaged by him to appellant. The bill charges that on the 2d December, 1833, it was agreed between the parties, that complainant was to convey the slaves to appellant, and appellant was to indorse the note of complainant for $2,800, payable at the Agricultural Bank, and to indorse the same on renewal, and that if appellant should be compelled to pay the same, then the slaves should be, to all intents and purposes, the property of appellant.…
