The plaintiff (appellee) sued the defendant (appellant) to recover damages for fourteen head of cattle alleged to have been killed by the defendant by negligently running its engines and cars over and against said animals. Eight of the animals mentioned in the complaint were eliminated by the court below, by reason of the statute of limitations, and the case was tried as to the remaining' six animals, before a jury.
