Evidence and Procedural History

Defendant Phillip Warren Smith was tried on two sets of charges: (1) attempted second-degree rape, second-degree sexual offense, and sexual battery for events occurring on 9 May 2011 and (2) obstruction of justice and attempted obstruction of justice for events occurring on 1 September 2011. The evidence at Defendant’s trial tended to show the following: Defendant was manager of a trailer park on Stillhouse Branch Road in Swain County.
