This is a proceeding in the county court of Ford county to collect a special tax for the pavement of a portion of Market street in the city of Paxton in that county. The question of the validity of a. former proceeding in reference to the same improvement involved in the present suit was before this court at a former term; and the decision of this court in relation thereto is reported in the case of Pells v. People, 159 Ill. 580. By reference to that case it will be seen, that an ordinance was passed by the city council of Paxton on March 13,1893, amended on April 10,1893, and again on May 10, 1893, for the construction of a brick pavement sixty-one feet wide along a portion of Market street in the city of Paxton.
