This matter is before the Court on defendant’s motion to dismiss the complaint. We have read and considered the *1105briefs submitted by the parties and are fully advised in the premises.

The complaint was filed in the name of Courtney Leroy Vallentine, a Ward, by Daniel S. Hoffman, his Conservator. The defendant is Taylor Investment Co. and Taylor Investment Co. doing business as Ramada Inn Motel, a citizen of Colorado.
