On the former appearance of this case before this court it was held that “this ease in principle is controlled by Byrd v. Thompson, 146 Ga. 300 (91 S. E. 100), and cit. The court erred in overruling the general demurrer to the petition.” See 23 Ga. App. 250 (97 S. E. 868), where the allegations in the original petition are set out.
