McLEAN, Circuit Justice.

This action was brought against the defendant as the indorser of a promissory note. The attorney, Mr. Lockwood, being sworn as a witness, stated, that he received the note for collection some time in the year 1838. That he shortly afterwards called on the defendant, as in-dorser, who admitted that he had received regular notice of the nonpayment of the note, and that he was liable to pay it.
