Concerned about what they claimed were false representations Nestle Waters North America, Inc. (Nestle), was making about the source and quality of water it sold under the “Poland Spring” label, several Nestle competitors hired lawyers to bring suit. The lawyers concluded that consumers as well as competitors had been adversely affected by the false representations, so they contemplated pressing a consumer class action along with the competitor claims.
