This is an appeal from an order of the Monmouth County Surrogate's Court dismissing an order to show cause why a previous order of the surrogate admitting to probate the will of Eleanor Simpson should not be set aside.
The first question to be disposed of is whether or not this appeal is properly before the Prerogative Court. The decedent's will was probated before the surrogate of Monmouth County on February 16th, 1942, and a decree of the surrogate admitting the will to probate entered on that day.
