Appellant, Joe Chilton, who ivas convicted of themur-. der of Dollins Hawkins and given a. life sentence.in.the penitentiary, seeks a reversal of the judgment.

For a proper understanding of the questions- raised a brief statement of the facts will be- necessary. It appears that appellant, with his wife and three children, lived in Anderson county about -eight miles from Lawrenceburg. and near the Bond Brothers’ Distillery on Gilbert’s creek.
