This action was brought to recover the sum of $199.56 due upon a promissory note dated April 9,1895, given by defendant to plaintiff.

The answer admitted the execution of the note, and by way of defense alleged that in 1892 plaintiff and defendant entered into a certain contract whereby plaintiff agreed to drill and construct for defendant upon his farm a tubular well which would produce *290an abundant and never-failing supply of water, and in sufficient quantities for tbe purposes of defendant’s wants; that in pursuance of such contract the plaintiff drilled a well to the depth of about one…
