OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW
TOM G. DAVIS, Judge.
Trial was before the court upon appellant’s plea of not guilty of false report to a peace officer. V.T.C.A. Penal Code, Sec. 37.08(a)(1).1 After finding appellant guilty, the court assessed punishment at ten days probated. The conviction was affirmed by the Court of Appeals for the Second Supreme Judicial District (Fort Worth) in an unpublished opinion.
