Factual Background and Procedural History
In 2012, Pamela Love Alexander and her son, Eric Brooks, took Defendant Kevin Levi Davis in and allowed him to live at their home in Weaverville, North Carolina. Davis lived off and on in the home with Alexander and Brooks until he moved out a week or two before 29 January 2013. On 29 January 2013, Brooks discovered several items missing from the home and reported a break-in and theft to the Buncombe County Sheriff's Department.
