[1] Respondent, D. E. Brown, Jr., in his motion alleged that it did not appear from the records that an application for a rehearing had been made from the judgment rendered by the Court of Appeal. It appears that the opinion of the Court of Appeal was handed down on the 29th day of June, 1911. The minutes of the court proceedings show that on the 29th day of June, 1912, an application for a rehearing was refused. There was an unusual delay between the date the original decision was rendered and the date the application for a rehearing was overruled.…
