HUNT, Circuit Judge.

The West Side Irrigating Company, appellant, asks review of an order of the District Court dismissing an amended complaint and entering judgment accordingly. The suit was originally brought by the United States to restrain the Irrigating Company from diverting water from the Yakima river in violation of a certain agreement dated October 21, 1905. Final decree was entered in favor of the United States and upon appeal to this court we affirmed, the decree, and subsequently remittitur from this court was filed in the District Court in November, 1917.
