Appeal from a judgment of the County Court of Schenectady County (Harrigan, J.), rendered December 23, 1994, which revoked defendant’s probation and imposed a sentence of imprisonment.

In January 1994, upon his plea of guilty, defendant was convicted of the crimes of aggravated unlicensed operation of a motor vehicle in the first degree and driving while intoxicated. He was fined and sentenced to a term of five years’ probation. In December 1994, defendant was charged with violating the *764terms of his probation.
